Our Experienced New York City Attorneys Can Help

State and federal laws protect workers from gender discrimination. Unfortunately, many victims of sexual harassment are reluctant to come forth with a claim, fearing retaliation and job loss.

Three Types Of Gender Discrimination Claims

Gender Discrimination claims are broken down into three general categories:

Refusal To Hire Or To Offer Promotions Or Fringe Benefits

Claims in which a company refuses to hire a man or woman because of his or her gender, or refuses to promote a person for that reason, or denies other types of job benefits (like sick leave, vacations, pension plans, work schedules, etc.)

Wrongful Termination

Claims in which an employee is fired because of her or his gender.

Hostile Work Environment / Harassment

Claims involving inappropriate behavior in the workplace, including disparaging or sexist comments about one gender or the other or abusive treatment aimed at only one gender.

What New York State And Federal Laws Protect Employees From Gender Discrimination?

With the exception of small workplaces, in New York, the minimum number of employees is four, and all workers have powerful protection against discrimination. These protections come from several different state, municipal and federal laws:

  • New York State Human Rights Law (NYSHRL): Prohibits discrimination based on characteristics such as age, race, creed, color, sex, disability, and more. The New York State Division of Human Rights enforces these protections.
  • New York City Human Rights Law (NYCHRL): Offers extensive protections against discrimination in employment, housing, and public accommodations, covering a wide range of protected classes.
  • Title VII of the Civil Rights Act of 1964: Prohibits discrimination based on race, color, religion, sex, and national origin. The Equal Employment Opportunity Commission (EEOC) is the main enforcer of this law.

At Eisenberg & Baum, LLP, we have considerable experience working with clients facing issues, and utilizing these laws to protect their rights.

What Are Common Examples Of Gender And Sex Discrimination In The Workplace?

Gender and sex discrimination is probably the most common type of discrimination, and the most common and famous examples include:

  • Pay discrepancy with men being paid more than women
  • “The glass ceiling”
  • Favorable assignments being given to men
  • Important meetings held in spaces women can’t access
  • Refusal to allow access to facilities that match a person’s gender identity

Anything that could be attributed to “the old boys’ club” mentality can almost certainly be considered a form of gender discrimination.
