Your Fight For Justice Is Our Team’s Priority

New York City Disability Discrimination Lawyers

At Eisenberg & Baum, LLP, we understand the many challenges individuals with disabilities face in the workplace. Qualified people should always be treated fairly based on their job performance, not disability prejudice. Our disability discrimination lawyers are ready to take up your cause.

The Americans with Disabilities Act (ADA), the New York State Human Rights Law (NYSHRL), the New York City Human Rights Law (NYCHRL) and other laws prohibit workplace disability discrimination. These laws also require employers to provide reasonable accommodations for workers with disabilities.

Many other jurisdictions also have laws prohibiting disability discrimination. Based in Manhattan, we handle workplace discrimination and broader disability rights cases nationwide.

If you suspect you have experienced job discrimination due to your disability, contact us now for a free initial consultation. We take these cases on a contingency-fee basis, which means you pay us nothing unless we win your case. We pride ourselves on inclusivity and have ASL-trained attorneys and staff ready to assist people who are deaf or hard of hearing.

Which Workers Do These Laws Cover?

In order to claim disability discrimination, you must have a qualifying disability and work for a covered employer.

Qualifying disabilities include virtually anything that limits a major life activity such as hearing, seeing, walking or learning, for example. The disability can also be related to your mental health. The New York laws offer broader protections than the ADA, covering more types of impairments.

Generally, the ADA applies to employees of private employers with 15 or more workers, along with the employees of government agencies, employment agencies and unions of a certain size. The NYSHRL and NYCHRL cover both employees and independent contractors of smaller private employers, along with workers for governments, employment agencies and unions. If you are not sure whether the law covers your employer, our disability discrimination lawyers can find out.

How Does Reasonable Accommodation For Disabilities Work?

The law requires employers to make reasonable accommodations to allow workers with disabilities to perform their assigned job duties, except when the requested accommodation would create undue difficulty or expense for the business.

What accommodations are reasonable varies. However, they often include adaptive equipment, modified work schedules or locations, and changes to workplace policies. Each situation is unique, and the employer and worker should negotiate for what the worker reasonably needs.

What Are Common Examples Of Disability Discrimination In The Workplace?

It can sometimes be difficult to tell whether you have a job discrimination claim. That said, disability-based discrimination can occur in a variety of ways:

  • An employer making ableist assumptions about your qualifications and abilities
  • An employer not hiring you because of your disability
  • An employer passing you over for promotions or giving you less favorable assignments
  • An employer denying you time off for medical needs
  • Enduring harassment related to your disability
  • An employer refusing you a necessary job transfer to accommodate your disability
  • An employer refusing to provide another type of reasonable accommodation

These examples underscore the importance of understanding your rights. Our disability discrimination lawyers can help you understand your rights and take aggressive action to defend them.
